Terms of Use

Last updated: 21/10/2026

1. Who we are

This website, hartshornemarine.com, and the apps listed below are operated by Hartshorne Marine, a business name of Lucky Kat Pty Ltd, ABN 70 691 268 309 (“Hartshorne Marine”, “we”, “us”, “our”). We are based in Queensland, Australia.

You can contact us at garry@hartshornemarine.com.

2. About these terms

These terms apply when you use our website, including the free cruising guides, and our apps. By using the website or an app, you agree to these terms. If you don’t agree, please don’t use them.

Nothing in these terms limits any rights you have under the Australian Consumer Law. See section 9.

3. Using the website

You may browse the website, read its content and share links to it for your own personal, non-commercial use. When using the website, you must not:

  • use it for anything unlawful or misleading;
  • try to interfere with how it works, or get unauthorised access to it or to the systems behind it;
  • copy large parts of it, or scrape or harvest its content, by automated means without our written permission; or
  • republish or sell its content, except as allowed in section 7.

We try to keep the website accurate and available, but we don’t promise it will always be complete, current, error-free or uninterrupted. We may change, suspend or remove any part of it at any time.

The website links to other websites, including official sources such as Maritime Safety Queensland, the Australian Hydrographic Office, Transport for NSW and the Great Barrier Reef Marine Park Authority. We don’t control those websites and aren’t responsible for their content. Their own terms apply when you use them.

4. The cruising guides

NOT FOR NAVIGATION

The cruising guides are planning notes only. They are not charts and must not be used for navigation.

Always navigate using current official charts, Notices to Mariners, tide tables and other official sources, including Maritime Safety Queensland (MSQ) and the Australian Hydrographic Service (AHS), and, in New South Wales waters, Transport for NSW. Where our guides differ from an official source, the official source prevails.

Bars, entrances, channels, depths, aids to navigation, moorings, facilities and contact details change. Information in the guides may be out of date or wrong, even if it was correct when we last checked it.

The cruising guides at /cruising-guides/ are free to read. They are written from the experience of a working delivery skipper and are meant to help you plan, not to replace the current chart, the Notices to Mariners or the tide tables. Maps on the guide pages are locator and overview maps only. Official maps are linked, not reproduced.

Each page may show the date it was last checked. That date tells you when we last reviewed the page. It does not mean the information is still current.

You and your skipper are responsible for checking current conditions, weather, tides, bar conditions, local notices and any restrictions (including marine park zoning) before and during any passage.

If you spot something wrong or out of date, please tell us at garry@hartshornemarine.com. We welcome corrections but can’t promise to make every change, or to make it by any particular time.

5. Our apps

This section applies to our apps: Squared Away Boat Check, Passage Planner, Sight & Fix, and Hartshorne Marine Work & Rest Log (each an “app”).

Your licence to use the apps

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use each app on devices you own or control, for your own use and in line with these terms. You must not copy, modify, reverse engineer, resell or redistribute an app, or remove any notices from it, except as the law allows. We may update, change or stop offering an app, or any feature, at any time.

Offline data

Some apps store information on your device so they can work without an internet connection. Offline data is only as current as the last time it was updated, and it may be inaccurate, incomplete or out of date. Check it against current official sources before you rely on it.

The skipper stays responsible

The apps are aids only. They do not replace official charts, publications, proper seamanship, a proper lookout, or the judgement of the skipper. The skipper or user remains solely responsible for all navigation, passage planning, vessel readiness, crew, safety and fatigue decisions, and for complying with any laws that apply to the vessel and voyage.

Calculations, checklists, plans, fixes and logs produced by an app depend on what you enter and on your device. Check them yourself. To the extent permitted by law (see section 9), we are not liable for any decision you or your skipper make, or any action you take or don’t take, based on an app.

No regulatory approval

We do not claim that any app is approved by, or meets the requirements of, any regulator, standard or law. For example, a checklist in Squared Away Boat Check is not a survey or inspection, and a record in Hartshorne Marine Work & Rest Log is a personal record-keeping aid only. It is up to you to work out what records, equipment and checks the law requires for your vessel and voyage.

App Store and Google Play

If you download an app from the Apple App Store or Google Play, that store’s terms and policies also apply. If those terms conflict with these terms, the store’s terms take precedence to the extent they apply to you. Apple and Google are not responsible for our apps or for supporting them, except as their own terms say.

6. Yacht delivery services

These terms cover the website and apps only. Yacht delivery and related services are governed by our delivery contract, available at /contract, together with any written quote or agreement for your delivery. If there is any conflict between these terms and the delivery contract about a delivery, the delivery contract applies.

7. Intellectual property

The website, the cruising guides and the apps, including their text, photos, maps we have drawn, design, software and the Hartshorne Marine name and logo, are owned by Lucky Kat Pty Ltd or used under licence. Some content comes from other sources and is credited on the page, for example coastline data from Natural Earth (public domain). Official maps and publications belong to their publishers.

You may view, download and print pages for your own personal, non-commercial use, such as planning a passage. You may share links to our pages. You must not otherwise copy, republish, sell or adapt our content, or use our name or logo, without our written permission. Nothing in these terms limits any use the Copyright Act 1968 (Cth) allows.

8. Privacy

Our Privacy Policy explains how we collect, use and handle personal information, including through the website and apps.

9. Australian Consumer Law and our liability

Your consumer rights. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or modified.

Where we can limit our liability. Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited, at our option, to:

  • for services: supplying the services again, or paying the cost of having them supplied again; and
  • for goods: replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.

Other liability. Subject to the paragraphs above, and only to the extent permitted by law:

  • we provide the website, cruising guides and apps “as is”, and we exclude all other warranties and conditions not set out in these terms; and
  • we are not liable for any loss or damage arising from your use of, or reliance on, the website, the cruising guides or the apps, including loss or damage to a vessel, personal injury, or indirect or consequential loss.

Nothing in this section limits our liability for anything the law does not allow us to limit, such as liability for our own fraud.

10. Changes to these terms

We may update these terms from time to time, for example when we add guides or apps or the law changes. We will post the updated terms on this page and change the “Last updated” date at the top. The terms in place when you use the website or an app apply to that use. If you keep using the website or apps after an update, you accept the updated terms.

11. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them.

If any part of these terms is invalid or unenforceable, it will be read down or severed so the rest of the terms still apply.
